Child Custody Mediation Process
Summary
In child custody and support cases, courts prioritize childrens best interests. If mediation is delayed due to non-response, you can request court intervention to enforce compliance or proceed without mediation. The court will evaluate both parents roles in visitation and support. If the other party remains unresponsive, consider asking the court to address non-compliance and discuss visitation and support issues. You may also seek guidance from local legal professionals to navigate the process effectively.Full Conversation
Okay so let me break it down. My kids dad and I separated in *. He stopped coming around in * has had no physical contact or communication with the children since. In March of this year he demanded visitation or he would stop paying the support he was willingly paying. I denied his request and he stopped paying. I filed for child support through the state of Illinois */*/* and in return he filed a motion for a parent child relationship on */*/*. We have had one status conference and we were both ordered to take a parenting class and mediation. His side has had the mediation paperwork for * weeks now without responding to my side. What’s going to happen
Hey ****! In situations like yours, the court typically seeks to ensure the best interests of the children. Here's what might happen:
- If the mediation paperwork isn't responded to, you might need to request the court to enforce compliance or proceed without mediation.
- The court will assess both parents' involvement and intentions regarding visitation and support.
Have you considered reaching out to your local court for guidance on mediation delays?
They’ve been trying to contact his side but have not gotten a response.
It sounds frustrating, ****. If his side remains unresponsive, you might consider:
- Asking the court to intervene and enforce mediation.
- Requesting a hearing to address non-compliance and discuss visitation/support.
