Child Custody Legal Rights

Summary

In child custody cases, due process must be followed, ensuring fair procedures before removing a child. Disability rights require accommodations for mental disabilities, such as communication assistance and support persons. False allegations should be thoroughly investigated. DHS must provide reasonable modifications and accessible information to individuals with disabilities. If you suspect violations, consider consulting a family law attorney or advocacy group for guidance.

Okay, back in September of last year, my daughter, her name is Lily, and her child's father, his name is Caden, they had a baby in July of last year, July 10th, my grandson, his name is Caden Jr. So, Caden Sr. moved back to Fairview, Oklahoma, where he lives now, and three weeks later, my daughter moved from Wichita and went to go live with him. She has no family out there, no friends, no support system at this time, okay? So, she hadn't been there even a month. They were living with Caden's mother, Cassie, at first, and then they were waiting for the apartment to get redone, and then they moved into an apartment. I have more info
It sounds like a complex situation. Could you please share more details about the legal issue your daughter and her child's father are facing? This will help me provide more accurate information.
Well, one night, Caden and his mother conspired to try to take Lily, my daughter's baby, away from her and keep her baby away from her by Caden going to the police department and making false allegations of child abuse against Lily and domestic assault against him. So, she was served a no-contact order in September, in the middle of the night, like late September, I want to say September 29th, in the middle of the night, and she was forced to leave the apartment and was not allowed around her son or Caden Sr. until the order was dropped or some kind of resolution came to. Well, during that process of the order still standing, it stood for like a month because Lily had to find her a lawyer and all this stuff. So, I did all that. The order against her eventually got dropped, but in that time where she wasn't allowed around Caden Sr. or her son, Caden Sr. tried to commit suicide and the baby was taken into custody by the state of Oklahoma. I have more info
Thank you for the detailed information. It sounds like a very challenging situation. To provide more relevant guidance, could you please tell me what specific legal assistance or information you are seeking for Lily and her baby at this moment?
So, after the protection order got dropped on Lily, and granted she never abused her son, nothing like that, Caden, it was all false allegations, but the state still took the baby anyways. Now, Caden Sr. went to rehab or is in rehab or something, and Lily is having to fight with the Oklahoma DHS because her baby is in foster care now, when she legally did nothing wrong, and all this stuff was false allegations. So, she's having to basically fight with the state to get her son back, even though she was falsely accused of child abuse. The baby even went to the hospital that night and got a clean bill of health showing no signs of abuse whatsoever. So, she's still having to do this. Here we are in February. I have more info
It sounds like a really tough situation for Lily. Here are some general steps she can take to fight for her son's return:
- Document Everything: Keep records of all interactions with DHS, court documents, and any evidence showing her innocence.
- Legal Representation: Ensure she has a good family law attorney experienced in child custody cases.
- Court Hearings: Attend all court hearings and comply with court orders.
- Evidence: Gather and present evidence showing she is a fit parent, including the hospital report.

So, she's in that apartment. He's gone. She's mentally disabled. She gets SSI. Is there any type of legal representation she could get for her situation with her son? Like, wrongly accused? Is there any kind of free representation for mentally disabled people? She's out there all on her own. They talk to her. They know she's disabled. Shouldn't she have some kind of worker with her while this is happening or whatever? Is there any kind of help for her?
