Im currently in a custody battle with my children's aunt on their dads side. I left my mentally and physically abusive relationship and asked them to look after the kids until I can get on my feet. They filed for emergency custody and have accused me if abandoning my kids. The woman who has emergency custody if my kids accused me of abandoning them and not checking up on them . She wrote that I had not even attempted to contact the kids under oath but I have text messages proving she lied under oath. Now, after pre-trial, she has stated that if the courts award me full custody, I will be doing everything by myself and they are not willing to stay in the kids lives. Can i use this in court to prove she doesnt actually want my kids and just wants the child support? I am the legal biological mother.
