I am currently trying to leave an abusive relationship in Georgia. All my family and friends/SUPPORT people are in NY. I have a friend willing to help me get back to NY but I need to know if I need to establish custody of my child before leaving Georgia
Hello Amanda, I'm sorry to hear about your situation. Generally:
- If there's no court order, you have a right to leave with your child.
- If a custody order exists, you must follow it unless it's changed by the court.
- If the other parent files in Georgia, you might have to return for court.
