I got divorced about 8 years ago and the child is * now. I get to see here every other weekend but in the summer it switches to every week. She is a teacher and has summers off and is trying in enforce the following clause in our divorce agreement that states: "Either parent, at their discretion, may exercise additional parenting time on weekdays between 730am and 5pm when the child would otherwise be in the care of a 3rd party." I am able to work from home when she is with me and I told my ex that meaning she will be with me and not a third party during the week. The ex said I have to prove that I can work from home and to give her a letter from my supervisor saying I am able to. What do I have to provide or not have to provide to my ex? Side note: this is super frustrating because we have equal rights as parents but I am not allowed to make decisions (example: she switched our daughters school without even talking to me).
Hello ****, I understand your frustration. To provide accurate information, could you please tell me in which state this agreement was made?
Minnesota
Hello ****. Based on Minnesota law:
- No law requires you to provide proof of work from home ability.
- If your ex-partner violates the agreement (like changing schools without consulting), consult a lawyer.
