I have shared legal and physical custody of two children with their father. The day before the scheduled intake appointment, father called the facility and canceled the appointment and changed the location to a different facility, without letting mom know of any changes. The day of the appointment, father refuses to take the son to the original location stating that it till impede on his custodial time with the child. Mom would like to file for emergency relief and take son from father for medical neglect and file for contempt for his changing of the original appointment time. Is mom able to do so legally?
