My concern is the noncustodial parent never initiates contact. Only communicates with the teens because he states that group communication is placing the kids in the middle. And that he knows how difficult that is because he is the child of divorced parents (even though his parents divorced when he was in college).
It sounds like you're dealing with some communication challenges with the noncustodial parent. Custody agreements often outline communication expectations. If your current agreement does not specify this, you might consider discussing or revisiting the agreement with legal counsel. Is your custody agreement explicit about communication requirements?
I’m trying to keep this out of court but definitely having major issues. The noncustodial parent lives 2hrs away, is not involved in the day to day parenting responsibilities of the teens yet acts like he has the same rights as I do as the primary, custodial parent. Does he have any leverage to take my parenting time away ?
It sounds like a challenging situation. In New York, the noncustodial parent's rights are typically outlined in the custody agreement. They may have visitation rights but cannot unilaterally change your parenting time without a court order. If your agreement is vague, it might be worth consulting a lawyer to clarify and protect your rights. Have you considered having a lawyer review your custody agreement to ensure it reflects your current situation?
