Illinois Compensation Fund Limitations

Summary

Victims of theft or fraud in Illinois may not qualify for the states Victim Compensation Fund, which is typically reserved for violent crimes. However, legal options such as civil litigation or insurance claims may be available to recover stolen funds or damages. If a defendant avoids service, alternative methods like mail or public notice can be requested, though challenges exist if the defendant is unemployed. Legal aid organizations or the Illinois State Bar Association may offer pro bono services or guidance. Documenting service attempts thoroughly and seeking legal advice can be beneficial.

I'm really sorry to hear about your situation. Since you're dealing with an elusive defendant and financial loss, here are a few options you might consider:
- Alternative Service: If the defendant avoids being served, you can request the court for alternative service methods, such as mail or public notice.
- Judgment Collection: Once you obtain a judgment, there are methods to collect, like garnishing wages or bank levies, but these can be challenging if the defendant is unemployed.
- Legal Aid: Consider contacting Illinois Legal Aid for guidance on pursuing your case further.
- Consultation with a Lawyer: It might be beneficial to consult with a lawyer to explore other legal avenues.

so i already requested alternate service in small claims court she denied me since it is financial said i cant do that but i did file certified mail thru the circuit clerk last court date should have been it but the judge says it does not show proof of service so again another court date meanwhile i am suffereing filnancially because of him 2 years after the fact now
It sounds like you're facing a challenging situation. Since the judge mentioned lack of proof of service, you might want to ensure that all service attempts are well-documented. Consider these steps:
- Recheck Service Attempts: Make sure you've documented every attempt at service thoroughly.
- Seek Legal Advice: A local attorney might offer strategies for effective service or assist with navigating the process.
