Attorney Withdrawal And Deadlines

Summary

If a judge denies an attorneys motion to withdraw, the attorney remains responsible for the case. Confirm if a 60-day stay is still in effect and check for new trial dates. If communication with your attorney is challenging, consider sending a formal request for updates and files. You can also contact the court to verify any deadlines. If necessary, file a complaint with the New York State Bar Association. Court documents can provide clarity on orders and schedules, so obtain copies from the court clerk.

My attorneys want to withdraw but my case was close to a date to set trial and the judge threw out their motion today. They originally had to show cause for a discovery concern on May * but wanted and extension that was granted for June 11th. In the meantime on June 5th they asked for a 60 day stay and to withdraw counsel. The preliminary conference outlined the dates to have trial date to be determined on */*/* to be held within 30 days of that date and here we are on */*/* and they may serve me again to try to quit but what happens with the stay and the dates on the calendar that was missed and what are the new dates that has to be done by. It’s been * out of 60 days for the stay. What’s the next steps?
****, it sounds like a complex situation. Generally, if a judge denies a motion to withdraw, your attorneys are still responsible for your case. You should:

- Consider consulting with another attorney for guidance on how to proceed.
Do you need help connecting with local lawyers who can assist you further with your case?
Not just yet but thanks. I have some case documents and one she submitted was her notes stating how she cut me off talking and told me I didn’t tell the paralegal what I did tell him and that she didn’t think I would settle so they would have to file a motion to leave eventually most likely and now here we are.
It sounds like there's a lot going on with your case, ****. Here are a few things you might consider doing next:
- Review the Judge's Order: Make sure you understand the reasons for denying the withdrawal.
- Communicate with Your Attorneys: Discuss any concerns and the next steps regarding your case.
- Check Court Calendar: Verify the status of the *-day stay and any impending court dates.
- Document Everything: Keep detailed notes of communications and developments.

The judge didn’t say anything about the court dates in court today just that they had to serve me again and have no timeline. Should I assume it’s within the 60 days or how does it work?
Case Rating: *
****, generally, if a judge orders a party to serve you again, they must comply with the rules of civil procedure, which typically have specific timelines. Since your case involves a *-day stay, it might be wise to assume this could be a relevant timeframe, but it's best to confirm with the court. Checking with the court clerk directly can provide clarity on any deadlines or pending dates. If you have more questions or need further assistance, feel free to ask!
Can you tell me by court documents?
