Im sorry there is confusion. James cronan attended the hearing tofday at 2pm stating that he didint get served. So he reguested a continuanace at which time the opposing counsel said that he did send him the motion which was about the hearing. Now I want to send a followup motion to set the record straight that I James did not get the motion from opposing counsel. I will attch a screen shot of Mr. Croan's email box.
It sounds like you need to file a Motion to Clarify to set the record straight regarding the service of the motion. Here’s a general outline for you:
---
COMMONWEALTH OF MASSACHUSETTS
[Your County]
[Your Court Name]
[Docket Number]
James Cronan, Plaintiff
v.
[Opposing Party's Name], Defendant
MOTION TO CLARIFY
James Cronan respectfully requests that this Honorable Court accept this motion to clarify the record regarding the service of the motion to strike. In support of this motion, Plaintiff states as follows:
*. On [Date of Hearing], I, James Cronan, attended the hearing unprepared because I did not receive the motion to strike from opposing counsel, Mr. Kusinitz.
*. During the hearing, Mr. Kusinitz claimed he had sent me the motion via email, which I did not receive.
*. Attached is a screenshot showing no email from Mr. Kusinitz since November.
*. The bottom of the screenshot also shows Ms. Marley's confirmation that my new email address was updated in the system, indicating Mr. Kusinitz had the correct email address.
WHEREFORE, James Cronan respectfully requests that this Honorable Court acknowledge the lack of service and consider this in any future hearings or proceedings.
Respectfully submitted,
James Cronan
