i am plaintiff in civil lawsuit against property owner for disposing of my personal property property after eviction and denied access to remove personal property when requested within 14 day time limit. Their (defendant's) attorney is bringing up a pending court case against me (plaintiff) charged for insurance fraud to discredit me (my character). Is this allowed?
In a civil case, opposing attorneys may attempt to introduce evidence to challenge a party's credibility or character. However, there are rules about what is admissible:
- Evidence of unrelated charges is generally not admissible unless it directly relates to the case.
- Pending charges (not convictions) are often inadmissible because they are not proven facts.
- Arizona Rules of Evidence, especially Rule * and Rule *, may limit character evidence or evidence that unfairly prejudices the jury.
You can object to this evidence in court, arguing it’s irrelevant or prejudicial. An attorney could help ensure these rules are applied.
