I received a file stamped copy of petition to remove execuotor, and a motion for declaratory judgement. i did not receive a copy of the order for declaratory judgement as I was told there is no order until the judge decides. i'm pro se and i need to serve the defendant and attorney. do i include the order for declatory judgement or do i leave out ?
Hey there! When serving the defendant and their attorney, you do not need to include an order for declaratory judgment if one has not been issued by the judge. You only need to serve the petition and motion that you have received.
Do you need any help with the process of serving these documents?
are you sure ? I don't want to mess this up!
Yes, I'm sure. Since there is no order issued yet, you only need to serve the petition to remove the executor and the motion for declaratory judgment that you have received. If you need help with the process of serving these documents, let me know.
