I have * witnesses of sheriff's harassing my ex boyfriend and myself after they foundout we were in a relationship as well as finding out that I'm transgender. The proof is in our arrest records, nothing between * and * then all of a sudden were both getting arrested once a month and they also took an old case from a different county and illegally reopened it in Kern county in order to arrest me and then I was scared and intimidated into taking a plea by my public defender. Civil Rights Violations under * U.S.C. § *: This federal law allows individuals to sue state and local government actors for violating their constitutional rights.
Equal Protection: You can argue that the sheriff's department treated you and your boyfriend differently based on your transgender status and relationship, violating the Equal Protection Clause of the Fourteenth Amendment. The case of Arriaga v. Dart discusses similar claims of discrimination and harassment based on transgender status against law enforcement officials.
Due Process: You can argue that the harassment and arrests, especially the reopening of the old case, were done without due process of law.
Malicious Prosecution: This claim arises when criminal proceedings are initiated without probable cause and for an improper purpose, and the proceedings terminate in your favor. The fact that an old case was reopened in a different county could suggest malicious prosecution.
