My boyfriend was convicted of unauthorized use of a motor vehicle, which he was convicted & sentenced to one year, whereas, he was picked up & arrested a second time by DeSoto County police in the state of Mississippi for the EXACT same crime, which he explained to his court appointed lawyer that he had already been convicted & sentence for the crime, and the public defender told him, that if he could prove it, than he would get with the District Attorney & have the case dismissed, which I contacted the lawyer who represented my boyfriend the first time & he called the public defender & the public defender had him email him the sentencing order & other documents PROVING that my boyfriend had already served time for the offense, whereas, the public defender said he went to the District Attorney with the information proving that my boyfriend had already served time for the offense, but the District Attorney still refused to dismiss the case, and the public defender told my boyfriend that if he didn't take the plea bargain for * yrs, they were gonna charge him as a habitual & give him life without, so my boyfriend got scared at hearing getting life without & accepted the plea of * yrs & will be getting released October of this year, so my question is, Is there anything that can be done concerning this matter of my boyfriend being convicted of the same offense twice as to civil rights violation & a civil suit being filled by a attorney?
