Summary
In California, students have rights against unreasonable searches, bullying, and wrongful expulsion. If your child faces such issues, document everything, file complaints with the school district and California Department of Education, and seek legal aid. Legal aid organizations like the Legal Aid Foundation of Los Angeles and Bay Area Legal Aid can provide assistance. Schools must ensure a safe environment, and expulsion based on unverified claims may violate educational rights. Consider consulting a lawyer specializing in juvenile and educational rights for further guidance.Full Conversation
For the expulsion, yes, but not for the first search. During the fourth grade there was no documentation. They just raided the home and then informed us that a terrorist threat was made by our fourth grader, which it wasn't. It was a comment about a gun and it was misconstrued, which turned into targeting and labeling him as a terrorist threat, making an example out of him with no evidence again. Fourth grade shaming him every day after they have searched the homes and found no evidence of access to guns.Yet they still every day look through his backpack in front of the whole school to humiliate him. What are our rights in california
Your son has several rights that may have been violated:
- Protection from Unreasonable Searches: Fourth Amendment rights protect against unreasonable searches and seizures.
- Right to Education: Expulsion based on unverified claims may infringe upon his right to education.
- Protection from Bullying: California schools must provide a safe environment free from bullying and harassment.
Given the severity of the situation, consulting with a lawyer would be a prudent step.
Have you considered filing a formal complaint with the school district or contacting an educational rights advocate?

My son was arrested based on hearsay of him being a terrorist and making terrorist threats against the school, but there were no witnesses other than children's hearsay. This is the second time this has happened once in fourth grade which the teacher decided to make an example out of him. After no weapons were found after the police did this home search. She proceeded to every day. Search his backpack in front of all the kids at the school when he was already bullied and then shamed him constantly targeting him, which caused him emotional and mental trauma, which now has led up to sixth grade where they're using. That as saying he's doing these things.Other children are lying and it's hearsay that he made these threats altogether. The home was rated again. There was no weapons found no evidence of a terrorist acts or anything taken in front of a psychologist.Had an evaluation still the psychologist says he's no danger to himself or anyone else or students or school staff members.Et.Cetera , do we have a suit on her hands in california
