I was pulled over in VA, eventually arrested due to suspicion of DUI. I invoked my 5th ammendment right to remain silent. at the jail, the deputy read me my miranda rights, and then the implied consent refusal form, adding that he would treat my silence as a refusal. he did charge me with dui, unreasonable refusal and speeding. i was found not guilty of dui, guilty of rufusal, and paid the speeding ticket. I appealed the refusal in civil court, appallate, but was found guilty at trial. I am appealing that to the state appeal process, supreme court. Was the law upheld correctly in my case, and is there any other recourse i could take if it were not?
