My elderly mother and father have a neighbor living across the street that has harassed them constantly over the last 10 years and has escalated in the last 18 months. The neighbor has almost struck my mother with her vehicle, has trespassed constantly (almost daily) despite a number of requests for the harassing neighbor to stop (including but not limited to: asking the neighbor to stop backing into their driveway beyond their property, posting a "no trespassing" sign, and calling the police), and has called my mother a "crazy black mama" and "crazy black karen" (the last comment we have on video) and there is suspicion that the neighbor is interfering with the signal on my parents wifi security cameras. We have dozens of videos showing the trespassing as well as the racial verbal assault. What charges can we file and what is the likelihood that my parents will be granted a civil restraining order (they live in Santa Clara County in California)?
I'm sorry to hear about the situation your parents are facing. Here are some potential legal steps and charges that can be pursued in California:
- Harassment and Trespassing: Your parents can consider filing a complaint for harassment and trespassing with the local police. Documented evidence, like videos, can support this.
- Civil Restraining Order: Given the evidence of harassment and threats, your parents may be eligible for a civil restraining order. The videos and police reports can strengthen their case.
- Hate Crime: The racial verbal assaults might qualify as a hate crime, which is a serious offense.

how likely is a hate crime charge for the neighbor harassing my mother and father for calling my mother a "crazy black karen"?
Case Rating: *
For a hate crime charge in California, the conduct must be motivated by bias against race or another protected characteristic. Given the racial verbal assaults captured on video, there's a potential for hate crime charges. However, pursuing this charge involves proving intent and may require further investigation. Consulting with a lawyer can provide clarity on how to proceed.
