Green Card Application Concerns
Summary
If you are approved for a green card through the lottery, your I-730 petition for your wife remains valid as it is linked to your asylum status, not the green card. Your wifes I-730 petition is independent of her current status and is based on your asylum approval. Consider consulting with an immigration attorney for personalized advice.Full Conversation

I was approved for asylum in *. A couple of months later, I applied for a green card (filled out form i-*). I also filled out form i-* so that my wife could also be granted status. My wife entered as a tourist and applied for asylum before the end of the term (she has a separate case) and she is still waiting for an interview.
A couple of months later, in May *, I found out that I also won the lottery, so we decided to simultaneously apply for i-* to change status through the lottery, and soon we will have an interview.
I have a question: If I am approved for a green card through the lottery, but she is denied (since she is probably out of status, although she applied for asylum while she was in status), then what will happen to form i-*? Will she still be able to get status?
P.S. We both in US.
If you are approved for a green card through the lottery, but your wife is denied, the form I-* should still remain valid. Here are a few key points:
- Form I-* allows you to petition for your spouse based on your asylum status.
- If you gain permanent residency (green card) through the Diversity Visa Lottery, it does not invalidate your I-* petition.
- Your wife's I-* petition remains tied to your asylum status approval, not your green card status.
