Privacy Rights For Students
Summary
In California, you have a right to privacy concerning personal information, including photographs. If your high school has published photos without your consent, you can request their removal. If the school refuses, consider sending a formal cease and desist letter. Additionally, if you experienced discrimination during your transition, you may have grounds for a discrimination claim. Under FERPA, you can request the removal of personal information. Ensure you have documented all communications with the school and bring copies of your written requests and relevant policies to meetings. Consider consulting a lawyer specializing in privacy or discrimination cases for further guidance.Full Conversation
it was when i was younger than * also but there are some things I feel might complicate the situation which was that during the time I was competing in those sports and events my name was legally jessica and I was a female. Then there was the point in which I transitioned and changed my legal name and sex to jonah. However due to what was a lack of support and being the first and only one who had transitioned it felt like everyone was looking at me expecting me to lead the way for what to do and guidance but there was some underlying prejudice and discrimination that I felt. This is what partially(among other factors) led the continuation of sports on the female team. So not only is my old identity being publicized but my new identity is being shown in a bad light
It seems you have a valid concern regarding privacy and potential discrimination. Here are some steps you can consider:
- Right to Privacy: Under California law, you have a right to privacy, including control over your images.
- Cease and Desist: If the school refuses to remove the photos, you can send a formal cease and desist letter.
- Discrimination: You may have grounds for a discrimination claim based on the prejudice you experienced.
Have you considered speaking with a lawyer who specializes in privacy or discrimination cases?
i had but i had wanted to try and have more info and documents before I reached out but it has been a kind of tumultuous process of getting the information since it has taken so long and Im about to go speak to the assistant superintendent today because they wanted to Best address my request in a timely manner and gain a better understanding of my request. Which to be perfectly honest I thought was quite clear as my request states: I am requesting the following one. Removal of my name and photographs from all records of my sports participation it's not possible replacement with an anonymous placeholder. To be restricted access to photographs or videos that cannot be edited to protect my privacy. Another thing is that on these websites even though I hear quested to take one of them down several times and because this website States in there privacy policy that the institution has two contact them if they want the information taken down and that they comply to FERPA
You have strong grounds for privacy concerns and potential discrimination. Here’s what you can do:
- FERPA Request: Under FERPA, you have the right to request removal of personal information.
- Formal Written Request: Ensure you have a written request specifying your privacy concerns.
- Cease and Desist: Consider sending a formal cease and desist letter if the school does not comply.
Have you documented all your communications with the school regarding these requests?
When I go into the meeting today should I have anything ready or what should I have prepared
Bring the following to your meeting:
- Copies of your written requests for removal of your photos and name.
- Documented communications (emails, letters) with the school.
- Any relevant FERPA information or privacy policies.
- A summary of your privacy and discrimination concerns.
Good luck with your meeting!
