My partner of * yrs retained a social security attorney last april *. The attorney was helping him with disability social security. The attorney took another job in june of * and mailed my partner a waiver of fee form that she says she also sent to social security. In july of * his case was approved and social security mailed her a check for *.*. She kept they money. Our question is does ahe have a right to that money or should it be returned to my partner?
Hello ****, this matter depends on the agreement between your partner and the lawyer. Typically, if a lawyer withdraws from a case, they may still be entitled to a fee, but there are rules for this.
- Did the lawyer complete the majority of the work before leaving?
- What does the waiver of fee form state?
This information can help me provide a more accurate response.
No i dont think so
Hello ****, if the lawyer did not complete the majority of the work, then keeping the entire fee might not be justified. However, this heavily depends on:
- The terms of the initial agreement
- Local state laws
- The specifics of the "waiver of fee" form
It is advisable to consult with another attorney for a detailed review.
Ok thank you
