Ssi Benefits Appeal Options

Full Conversation

My SSI was stopped because of a medical paper that the mental health office did not put it in my medical records so the alj judge couldn't look at it to find me still disabled and so because of that place not doing what the were supposed to do I am left with no income at all also I appealed to the appeals council and they did not review it and found me no longer disabled I have tried so many things to get this resolved which should have been taking care of by giving the alj judge the medical record that she needed I tried to get a message to the judge with no luck and talked to several different people to help me get my SSI back due to something not doing there job and I had no control or new anything about it. What can I do I'm suffering trying to live with no income and can not work and my mental health is getting worse so I am stuck in a position that I should have never been in. I need help what can I do
I'm sorry to hear about your situation, ****. In California, you may want to consider:
- Contacting a Social Security Disability lawyer for assistance
- Requesting a disability hearing again
- Acquiring new medical evidence showing your condition hasn't improved
Remember, this is general advice. For specifics, consult with a legal professional.
I have tried that but they all say I need to open a new claim which if I do SSI will just take my back pay away because I owe them money for overpayment which if this hadn't happened I would not owe them anything.
I understand your concern, ****. In California, if you're asked to open a new claim, it's often because your medical conditions have changed or the original decision was set aside. Some strategies include:
- Appeal the overpayment decision
- Apply for a waiver to not repay the overpayment
Remember, consult a legal professional for specific advice.
