Child Support Enforcement Challenges
Summary
Navigating child support enforcement across state lines involves understanding UIFSA for support and UCCJEA for custody. Proper service and evidence are crucial in contempt cases. If a court finds you in contempt without evidence or service, consider filing a motion to set aside the order. Legal aid and pro bono services can be helpful, but if unavailable, explore self-help resources or court facilitators. Consulting a family law attorney in Georgia or Tennessee may provide personalized guidance.Full Conversation

i live in gergia. my children and ex are in tennessee. i petitoned the tn court to register enfrce and modify parenting plan. the ex filed no answer but slipped in a motion for contempt of non- payment of support. the court did not allow any parenting plan modifications but instead found me in contempt. he provided no evidence and never served me.
Elizabeth, your situation raises several legal issues, including due process and jurisdictional concerns. Here are some points to consider:
- Due Process: You should have been properly served with the motion for contempt.
- Evidence: The court should require evidence before finding contempt.
- Jurisdiction: Ensure the Tennessee court has jurisdiction over your case.
Have you considered filing a motion to set aside the contempt order based on lack of service and evidence?

yes, i am just trying to deterine if that is the right option. i am confused between the uifsa and the uccjea and the proper way to register a support order. i would assume that some financial information is needed before the judge coukd d anything about a support order?
Hi Elizabeth! Here's some information to help clarify:
- UIFSA (Uniform Interstate Family Support Act): Governs the establishment, enforcement, and modification of child support orders across state lines.
- UCCJEA (Uniform Child Custody Jurisdiction and Enforcement Act): Covers jurisdiction for child custody and visitation matters.
- Registration of Support Order: Required for enforcement; financial information is typically needed.

No. I am drafting a petiton for contempt of parenting time/visitation has all contact has been denied for 18 months now. I asked child support enforcemet in tn to help and they said i must ask ga to help with the support provisions. when we were at our hearing i told the judge i was never served anything and he didnt seem to care. he dismissed my petition to modify parenting plan/custody bc evidence was not presented properly although judge viewed all the documents and clearly knew the violations and effects on the children. and instead issued a * page order, and found me in contempt of non payment and ordered the arrearage more than the monthly support obligations child support
