Vehicle Repossession Legal Steps

Summary

Vehicle repossession without notice and refusal to accept payment may violate washington laws. You can draft a letter to the prosecuting attorney and judge citing rcw 62a.9a-609, rcw 62a.9a-623, and rcw 19.86. These laws cover repossession rights, notice requirements, and consumer protection. Consider seeking legal advice to address the auction and loss of personal property.

Hi Frank! It sounds like your vehicle was repossessed due to a title loan. Here are some general steps you can consider:
- Confirm Repossession: Check with the title loan company to confirm they repossessed the vehicle.
- Understand Your Rights: In Washington, the lender must send a notice of sale after repossession.
- Redeem the Vehicle: You may have the right to reclaim the vehicle by paying the owed amount.

Re: Request for Legal Action Regarding Vehicle Repossession and Personal Property Loss
I am writing to formally request that charges be pressed and legal action be taken regarding my vehicle's repossession and the subsequent loss of my personal property. Below are the details of my case:
*. Vehicle Repossession: On [Date], my * Jeep Rubicon was repossessed by a title company in Idaho without prior notice. I had taken out a title loan on [Insert Date] and had already paid $*,* of the $*,* owed. However, the title loan company refused my final payment, insisting on cash only.
*. Lack of Notice and Refusal to Accept Payment: I was not provided with any notice of the repossession, and my payment attempts were unjustly rejected, which I believe violates UCC laws.
*. Auction and Loss of Personal Property: On April 3rd, I discovered my vehicle was at IAA Auction House. Upon arrival, I was informed that all my personal belongings inside the vehicle were missing. The auction house and towing company provided no information about the whereabouts of my property.
*. Outrageous Demands: The title loan company demanded $*,* in cash to return my vehicle, a sum that includes excessive interest charges.
I believe these actions are illegal and unethical, causing me significant financial and personal distress. I am the sole title holder of the vehicle, and these events have left me without transportation and essential personal belongings.
I kindly request your assistance in investigating this matter, pressing charges against the responsible parties, and taking any necessary legal action to prevent the auction of my vehicle. I also seek the return of my personal property and compensation for the distress and inconvenience caused.
Thank you for your attention to this urgent matter. I look forward to your prompt response.
Sincerely,

*. Lack of Notice and Refusal to Accept Payment: I was not provided with any notice of the repossession, and my payment attempts were unjustly rejected, which I believe violates Revised Code of Washington (RCW) 62A.9A-* and RCW 62A.9A-*. These statutes govern the rights and obligations of secured parties and debtors in repossession scenarios, including the requirement of proper notice and the right to redeem the collateral.
*. Auction and Loss of Personal Property: On April 3rd, I discovered my vehicle was at IAA Auction House. Upon arrival, I was informed that all my personal belongings inside the vehicle were missing. The auction house and towing company provided no information about the whereabouts of my property. RCW 62A.9A-* outlines the requirements for the disposition of collateral, including reasonable care of the debtor's property.
*. Outrageous Demands: The title loan company demanded $*,* in cash to return my vehicle, a sum that includes excessive interest charges. This demand appears to be in violation of Washington's Consumer Protection Act (RCW *.*), which prohibits unfair or deceptive acts in trade or commerce.
I believe these actions are illegal and unethical, causing me significant financial and personal distress. I am the sole title holder of the vehicle, and these events have left me without transportation and essential personal belongings.
