I have civil lawsuit questions regarding consumer protections.
Hello ****, I'd be happy to help with your civil lawsuit questions in the context of consumer protections. Can you please provide more details about your specific situation?
I got a transmission fluid change at Valvoline. Shortly after, my transmission experienced catastrophic failure. The repair shop I brought my vehicle to ran a full inspection and said that the transmission fluid had been overfilled. A manager working on behalf of Valvoline, tried to collect my transmission fluid twice without my knowledge or consent. When that did not work, he asked for my consent to have the vehicle towed to an unnamed repair shop near Valvoline. We didn't feel comfortable so we said we would make an appointment at the repair shop that the vehicle is currently at. He said no. Then we said we could bring it to a 3rd party that none of us had done business with before. He said no. The reason they wanted to tow my vehicle to a new repair shop was to drain the transmission pan and measure how much came out. But you can not get an accurate measurement from that because transmission fluid could be in the torque converter. Valvoline said if we didn't send the car to the repair place then we needed to go to court.
In Minnesota, you're protected by the Motor Vehicle Repair Act. Here's what it says:
- Repair shops must provide written estimates for repair work.
- Repairs must not exceed the estimate without your consent.
- Shops must return replaced parts if requested.
For your situation, if you believe Valvoline is at fault, consider contacting a consumer protection or personal injury attorney. They can advise you on your best course of action.
