An unlawful tow
Hey Brittany! Could you let me know your location? Different states have different rules regarding towing practices. This will help me give you more accurate information.
Tow
I am a resident in Humble, Texas located in Harris County. It is imperative that I also advise you that I am an indigent, unemployed, single mother suffering, with chronic health, multi-morbidities (inclusive of Mental Health challenges). I was unexpectedly laid off *.5 years ago; shortly after that time I noticed that I was experiencing a serious negative impact on my mental health and cognitive function. I was also four months very high risk pregnant????. I felt as if I was “stuck on stupid“. It was as if the devastation from unexpectedly, losing my only source of income put me in a lingering freeze response. The next thing I know it appeared as though I forgot everything I learned while working there and my mental state defaulted to how it was “post stroke”. I felt worthless and stupid and I still do. The negative impact in my cognitive function makes it nearly impossible to complete any task, especially if it is complex; regardless of it’s importance and I would fall into ADHD paralysis… overwhelmed, dysregulated and overstimulated. Meanwhile, my pile of things to do is longer my the day, and important business obligations are getting pushed further down on my list., which even includes the most important thing for the well-being of myself and my ability to take care of my family, and that is my inability to prioritize my own healthcare… It’s too challenging, frustrating and again extremely overwhelming… so ADHD paralysis kicks in and I go into a freeze response. I would like for you to keep that tidbit of information in your history if you can for future conversations. Having said all of that it was in November * * when I had finally depleted my savings and ran out of money and no longer had the ability to maintain my financial responsibilities. This was going to be the second year that I was not able to celebrate Christmas with my family, the first time I was not able to pay my rent or even give a definitive date of when I would be able to pay the rent. So you can only imagine my frustration when I walked outside to get something from my vehicle on March *, * and that my truck had been stolen but quickly realized that my * Ford escape had been unlawfully towed from his designated parking spot, that it is also registered to. victim of an unlawful tow that happened over six months ago from a private property resident it was registered to. To this day, I have not been able to obtain all of the information that should have been given to me after it was towed, I did receive two pieces of correspondence in the mail from the storage facility, but it did not have a phone number. The person who authorized the tow the license number of the tow truck operator, and the information regarding the tow hearing is so small that I cannot even read it but I was eventually able to have it read to me. Important important information like that should be clearly visible so that people with disabilities and vision problems can see it to read it and also ensure it’s in a language that’s easy to comprehend for people with cognitive impairments. This whole situation felt so abusive to me. I felt like every time I picked up the phone to call the tow company or the storage facility like they were just beating my head into the pavement because they didn’t care that it had been unlawfully towed with no notice whatsoever . They claimed that the tow truck operator had put a sticker on my window that said that it was abandoned, had a flat tire and was in operable… None of that was true, the back tire on the passenger side was low, but it was not completely flat in fact when I went outside that day to go get something from my truck it was so that AAA could come out, assess why the tire was losing air and repair the tire. Which I was doing because that upcoming Friday the vehicle was going to be sold so that I could have access to cash to take care of my financial responsibilities. Meanwhile, I had zero dollars to my name I could not even had paid for the tow hearing if I wanted to because once again, I had completely depleted all funds in my possession, and I certainly did not have any ability whatsoever to pay to get it out of the storage facility. Actually, I do own the vehicle, so I do have position of the title; however, every attempt I made and getting a title loan was a flop, because due to an unlawful, deceitful individuals fail to comply with legalities and basic human rights and engage in shotty business practices, and leave vulnerable people and devastating situations and due to no fault of my own. I did not have my vehicle in my possession which is needed when obtaining a title loan. At the end of April, I don’t have my notes in front of me, but I think it was around the 29th that the representative on the phone said that my vehicle was no longer at their storage facility, and had been released to the sheriffs department and had been sold at an auction! I seriously cannot make this up. She refused to provide me any details beyond that. However, she did give me my impound storage fees that had accumulated in excess of $* or so. I believe it is also important to point out that after hours of research, I discovered that the impound storage facility, was not only located on the other side of the street, directly behind the towing company… but that both companies are owned & operated by the same person. When a vehicle is towed from private property and it’s registered address and towed to a vehicle storage facility that accepts private property tows, Arthur certain laws in Harris County Texas that should be followed and shouldn’t impound storage facility ensure that they have been provided with all the pertinent information that they were to include on the notice that they mailed me? The fact that none of that seem to be done is a big red flag, and in my opinion would be a conflict of interest & basic ethical business practices, especially when observed from a legal standpoint. That’s just my opinion maybe because it’s my vehicle that was unlawfully towed, but that’s just how I feel and right is right and wrong is wrong. I have no idea who is responsible. I have no idea what to do. It has been seven months. I have no answer answers and not only was it unlawfully towed. I feel like it was stolen, but can’t file a police report because it was unlawfully towed Can’t find any information regarding the sheriff sale of the vehicle. I don’t know how much it was sold for or where the money went so many unanswered questions. I have no money to hire an attorney and I don’t know what to do anymore but I know I’ll probably never see my vehicle again but I paid $*,* cash for that vehicle And I feel like someone or some company is responsible for the replacement of that vehicle or compensation to me accordingly so that I can go and get another one meanwhile I’m stuck at home with my babygirl… I have not been able to get in my vehicle and drive to the store to get milk for her and over seven months… Or take her to a park to play or anything else…. this unlawful incident has had me in a constant state of distress & disbelief for the past 7 months… I have yet to speak to any one that is even remotely concerned about this incident. They are not the ones that have to face the repercussions and inconvenience of their unlawful actions, so they do not care that I am a single, unemployed, indigent mother…. suffering with multiple health comorbidities that I have significantly impacted my ability to secure any type of employment; they don’t see or care about the fact that they took something for me and my family, literally the only asset I had to my nam, just gone towed right from the carport that it’s registered to in broad daylight with no notice. They don’t see or care about the fact, not only was a not in a position financially to ever get the vehicle out of the impound storage facility, or gather the funds to request a tow hearing, I would not have even been able to get to the tow hearing without transportation, because this momma didn’t have the funds to even utilize ride share services. Oh, and just one last thing… on the notice that the storage facility mailed out to me… it displays the incorrect address for where it was actually towed from! I guess this was an attempt to make it appear like it was towed from somewhere that it was not which is just blatant l dishonesty, and Shawty business practices. And in my opinion as a struggling mom with disabilities, I find this extremely abusive not just from a poor standpoint, but definitely to our elder community and those suffering with disabilities. It’s almost like it’s intentional in affliction of distress because laws were not followed , I was not ever notified until after the fact,,. This is just a very disheartening & extremely disappointing situation.., the tow operator lied about the address where he towed it from, using the condominium clubhouse address…deceitful acts. The tow operator is very well aware of where he unlawfully hooked up my vehicle and towed it off without any form of proper notice. i and he can say he put a sticker on the window, but he would’ve had to do so discreetly and had it somewhere that was not visible to me. I’m pretty sure that when a tow operator tags a vehicle that is at risk of being towed utilizing a window sticker- especially on private property- that proper placement of the sticker tag would require ithe tag be placed in a position that is visibly obvious for the vehicle owner to see the warning…for example: when I walk out my back gate under carport, the vehicles windshield what I see first.. it should’ve been on the windshield rather than a side window from under the parking spot that my vehicle is registered to; literally the same carport it has been parked in for the 5years, so I know that
Who is legally responsible for unlawfully towing my vehicle in the first place? Don’t these companies having the same owner raise concerns?
Please help me and if you have any clarifying questions, please ask.

Who is responsible for monetary damages for the value of my vehicle that will be owed to me. Is that the owner of the companies? The unidentified tow operator? or do monetary damages for these type of deliberately, deceitful business practices for on the the responsibility of the towing company and/or the vehicle inbound storage facilities business Insurance policy? And how long do I have to legally seek monetary compensation owed to me for the unlawful tow and sell of my vehicle?

Just out of curiosity.. approximately what would does the monetary compensation look like for a victim that lost their vehicle due to no fault of their own, and was due to an unlawful tow and unfair, deceptive, and misleading business act from the tow company that took it to the storage facility. They also owns the company. He works for only for them to accept the vehicle without ensuring he obtained the appropriate information they were going to be required to send me in the mail, and how was it legal for them to even accept this without confirming that it was a tow that had been authorized by a legitimate third-party… the more I think about it the more complex it gets and I just don’t see how this was allowed????????????????♀️ especially a vehicle that was owned by a struggling single mother, who was already victim of the financial struggle.. so these unfair, deceptive, and abusive business practices, had this poor mommy struggling with suicidal ideation due to the unwarranted distress and frustration. I was fighting to keep my head above water and do my best to stay as grounded and stress-free as possible, so that I don’t have another stroke… I struggle with managing my chronic health comorbidities and the undue distress that this incident has caused me is not appreciated
Monetary compensation can vary widely, but here are some general considerations:
- Vehicle Value: Typically, the fair market value of your vehicle before it was unlawfully towed and sold.
- Storage and Towing Fees: Any fees you were unjustly charged.
- Emotional Distress: Compensation for emotional and mental distress might be claimed, but it's harder to quantify.
Would you like help calculating the fair market value of your vehicle or more information on emotional distress claims?

Just to confirm monetary compensation would just be for the value of the vehicle, of course any storage and towing fees, but would they not have to pay any monetary compensation to the victim for unfair, deceptive, and abusive business acts and practices?
In Texas, monetary compensation can include:
- Vehicle Value: Fair market value before the tow.

Just to confirm is it a conflict of interest for the towing company and the storage facility to have the same owner , specifically when handling private property tows in Harris County Texas?
It could indeed raise concerns about a conflict of interest. Here are some points to consider:
- Texas Law: Texas laws mandate proper notice and procedures for towing. Conflict of interest could be scrutinized under consumer protection laws.
- Ethical Concerns: Ownership of both entities could lead to unethical practices, such as lack of impartiality in handling tows.
