SHIPPING LINE ACT OF PAKSITAN
The Shipping Line Act of Pakistan does not exist. However, maritime issues are generally governed by the Carriage of Goods by Sea Act, * and the Contract Act, *. For a deeper understanding, it's recommended to consult a maritime lawyer in Sindh.
That the Plaintiff recently identified certain irregularities in the freight rates which were charged/ applied to Defendant No.* to * by one of Plaintiff's ex-employee i.e., Defendant No.*. That after a detailed internal investigation, it was unearthed that in some Export nominations booking forms submitted by the Defendant No.*, the reference of the Special Rate Agreements (which is only applicable to shipment of specific entities that comply with some criteria applied on a fair and non-discriminatory basis) were mentioned and all such bookings were processed by Defendant No.* at the behest ofthe Defendant No.* to *. It is pertinent to mention here that the said Special rates, were never supposed to be applied to the Defendant No.* booking, since Defendant No.* do not fulfill the required criteria, which was settled for Special rates. found guilty of violating the terms and conditions of his'Appointment contract and was in breach of company's code of conduct. Defendant No. * was terminated from his services with the Plaintiff Company on *.*.*. It is pertinent to mention here that during the internal investigation Defendant No.* disclosed that initially due to a bonafide mistake special rate was once applied to Defendant No.*'s shipment; however, after that Defendant No.* was blackmailed and forcefully lured by Defendant No.* through Defendant No. * to * to continue with such arrangement, otherwise a complaint will be filed by them before the Plaintiff alleging kickbacks on Defendant No.*. shipping line file one case in crminal court and second in civil cour for recovery, in crmianl court judg discharge to freight fowarder but in civil court is under process
It seems that the criminal case has been discharged in favor of the freight forwarder. For the ongoing civil case, it's important to gather all supporting evidence. Have you consulted with a civil lawyer to guide you through the process?
Could you please provide an explanation as to why an incorrect contract number was initially provided to the defendant by your staff member. in this question satff reply by mistak give this number and future FF black mail me to give more discount contract number. so waht do FF
It appears there's a concern about how the incorrect contract number was initially provided. Can you further clarify who exactly provided the incorrect number, and how it was used for blackmail? This will help me provide a more accurate legal perspective.
No evidence substantiates FF knew of inaccuracies at the material times. Mere assumptions are insufficient without factual proof of intention to defraud. is it suportted to FF
In legal matters, evidence is paramount. If there's no factual proof that the Freight Forwarder (FF) knew about the inaccuracies, and if there's no evidence of an intention to defraud, it could support the FF's case. However, the final decision rests with the court after considering all the evidence and arguments.
shipping line argu that the FF know about the business practice so why not FF as about contract detail. in this reply FF has informed that FF ask about the contraat number and some mentioned in shipping line booking note but shipping line said this is internel system generated you will recevied Bill of lading of your client with agreed rate and in process of shipment with diffrent department the inovice was recevied as agree rate on phone becuase mostly rate is deceide on phone this is practice in our business. we got invoice as per agreed rate, we paid invoice and clear the shipment from client now after * shipment has been cleared in one year. and now they asking for rate was with your shipment and pay differeneaila amount
The situation seems to revolve around a dispute over contract details and rates. Could you clarify if there was a written agreement about these rates, or were they only agreed upon verbally? Any documentation could potentially strengthen your position.
in our shipping line practice *% rate agree on phone. and we agree this rate on phone
Even though the rate was agreed upon verbally, did you receive any form of confirmation, like an email or a text message, that could serve as evidence for your agreement? This could be crucial in the ongoing civil case.
no we have evidence only thier invoice from finance department we have been paid
Having invoices paid as per the agreed rate can support your claim. However, it's advisable to maintain a written record of such agreements in future. Did the shipping line ever raise any concerns about these rates before filing the lawsuit?
yes shipping line after fired their staff which we give us the rate. then he contact us and we informed shipping line staff agreed this rate and send us contract number now shipping line staff asking we have sent contract number worngly where as we have process * shipment in a year. whereas staff is asking first rate i was worng giving after that FF black mail us and i give continue contract number whereas no evidence provide in court and same case in crminal court has been discharge to FF
It seems that you have been providing services based on an agreement with the staff, who is now terminated. Do you have any record of the conversations between you and the staff which could provide context to your agreement?
no
It would be beneficial to have some documentation or record of communication. However, since you don't, it's important to gather any other supportive evidence. Have you considered obtaining witness testimonies or similar?
paid invoice of shipping line is not evidence?
Paid invoices can serve as evidence to support your claim. However, the interpretation of this evidence depends on the court. Have you presented these invoices in the civil court case already?
shipping line alrady presented these invoces in court with suit file
If the shipping line has already presented the invoices, have you provided your own perspective and interpretation of these invoices to the court? For example, have you explained that the rates were agreed upon verbally and the invoices reflect those agreed rates?
no
It's crucial to present your interpretation of the evidence in court. Did your legal counsel advise you on the best way to frame your argument regarding the invoices and agreed rates?
our lawyer say case is fraud so no need to present invoice
It's important to follow your lawyer's advice. However, presenting evidence that supports your position, such as the invoices, can possibly strengthen your case. Please consult with your lawyer for best legal action.
