Puppy Return Contract Dispute
Summary
The enforceability of a puppy return contract depends on its specific terms. If the contract states that the dogs must be returned to the breeder and cannot be transferred without written consent, your rights may still be valid even after surrender to a shelter. Consulting a local attorney specializing in animal or contract law is recommended for specific guidance. Legal Aid Services of New Hampshire may also provide resources.Full Conversation
I sold two puppies two a woman in Mass back in * with a return contract if she could no longer keep them. I found out last week that they were surrendered to a shelter in *. One of the dogs got loose last week and I was called because they are microchipped to me. When I told the shelter I was the breeder and they couldn't bee signed over or sold they asked for my contract. I sent it to them and they said it was null and void after the surrender and I have no rights to the dogs. Is this true?
Hello ****. This is a complex issue involving contract law and animal law. Generally:
- The contract validity usually depends on its specific terms.
- If the contract states that it remains in effect regardless of any surrender, you may still have rights.
I recommend contacting a local attorney for more specific guidance.
My contract states that if for any reason they can no longer care for the dogs they are to be returned to me. The contract can not be transferred to a third party without written consent from me. The contract only applies to the original owner and can not be transferred to a second party.
Hello ****. Based on New Hampshire law and the terms of your contract:
- Your rights to the dogs may still be valid.
- Surrender to a shelter doesn't automatically void your contract.
- It might be useful to seek legal advice to discuss your options further.
Remember, this is general information. A local attorney can provide specific advice.
Any recommendations no one is breeder friendly that I have contacted.
I understand your concerns, ****. I would recommend searching for an attorney who specializes in animal law or contract law in New Hampshire. They might be more equipped to understand the nuances of your case. Legal Aid Services of New Hampshire could also provide resources.
