Verbal Agreement Dispute Resolution
Summary
Verbal agreements in Georgia can be binding, but proving them is challenging. Evidence like Facebook chats and plane tickets can help. Jurisdiction may depend on where the agreement was made. For breaches, gather additional evidence such as messages, witness statements, and expense receipts. Consider consulting a local attorney for guidance on enforcing the agreement and addressing non-payment issues.Full Conversation

Hi Jeren! What legal issue are you dealing with today?
I entered into a verbal agreement with a friend to travel with him from my home in Georgia to Texas for work. The agreement was reached and agreed to within the feed of a Facebook chat we were having. The agreement was to travel there, live within the residence in question while remodeling it, to assist in remodeling it. I would have to leave the job I currently held in Georgia to do so. In exchange for taking * dollars a hour less I'd be compensation with a profit percentage in the end. He and his uncle had a */* profit split agreement. He made me a 3rd party by offering me * percent of his * percent profit. All food was to be included, ride time and hotel reimbursement.
Hey Jeren! It sounds like a complex situation with your verbal agreement. To better assist, could you clarify if you have faced any issues with this agreement, like non-payment or breach of terms?
Just a moment there's more details
Thanks for sharing, Jeren. Could you clarify if there were any written confirmations or evidence of this agreement besides the Facebook chat? This can help determine the enforceability of the verbal contract.
Only written agreement was my record of this Facebook chat I have. And the record of the plane tickets purchased and sent to me for my initial traveling out to assist, which of course was purchased by him and sent to me as part of that agreement.

Yes, at jobs completion, his uncle claims he forfeited his share of the profit by accepting a job in Florida that was a full time position from their previous employer, and in doing that my agreement was voided, and that there was no profit to share after the sale. Yet he refuses to provide me documents showing that there's no profit. Further complicating this is that when I entered the agreement my friend and I resided in Georgia, the work was in Texas, and now my friend and his uncle reside in Florida and I'm still in Georgia, so jurisdiction isn't clear to me.

From what I've found jurisdiction would be Georgia because that's where we were during the initial agreement. What other types of evidence would be valid or helpful?

I entered into a verbal agreement to help remodel a home with a customer who verbally agreed that the profit of the job would be used to purchase a home to be provided as a residence for my son and I. Also my expenses occured for the project would be reimbursed and I'd receive a percentage of profit share for doing the contracting work along with the labor. The customer and her family would assist me on the weekends. Id be provided a laborer to assist me weekly, and materials would be available as needed.

During the project I was asked to defer portions of my labor payments to be paid at the selling of the home, which I did, totalling close to *. I had expenses of materials i provided from my personal supply of such in the amount of *. I don't have receipts of such as they were from stock, but I have pictures to prove those materials were used whereas they will not be able to provide proof that they purchased them because of course they did not. Close to job completion I was told not to return to the property, all lines of communication were blocked on their end making it impossible to communicate with them and I was directed to only deal with the husband moving forward, by postal mail only. This was in complete contrast to my dealing with the wife for the entire project, as well as other projects is done for them for the previous 8 years.

Hey Jeren! It sounds like you've experienced another breach of agreement. You may have a strong case for monetary claims given the unpaid labor and expenses. Have you considered documenting these attempts to communicate or the blockages in communication? This could further support your case. Would you like to be connected with local lawyers who can assist you with this issue?

The husband was never involved in the workings of such, just the wife. The husband is a attorney. The assistant I was promised never came to permission as they hired a full time yard hand who did not assist me, their weekend help turned out to be them coming periodically as wishes, to deliver staging furniture or to at times pick a task they wanted to tinker in, and leave the following day, leaving the tasks they completed done improperly and needing further repair, and leaving large furniture pieces in the way of any progress complicationg any future work rather than placing it in storage or somewhere not to hinder my progress.

My daughter was living with a guardian in Wyoming who was court ordered to return her to me in Georgia in a specific date. He violated the court order and sent her to her mother's family here in Georgia, in another county. They in turn have kept her from me and enrolled her in school somehow illegally and kept me from contacting her. She graduates next week. He clearly violated the order but I can't find assistance due to it being a family law issue crossing state lines and jurisdictions.

Hey Jeren, it sounds like a complicated situation involving family law across state lines. Here's what you might consider:
- The court order violation can be addressed legally, possibly in the state where the order was issued.
- You might need to file a motion in court to enforce the order and regain custody.
- Consider consulting a family law attorney experienced in interstate cases.
