How can I help with your legal question? Hi there, I have a bit of a lengthy and pretty complicase related to criminal battery and domestic violence charges in which I was the victim of - my ex partner was the party who commited these acts and who ultimately was arrested and charged appropriately with DV battery with potential for grave bodily harm. To keep it brief. She was arraigned about 6 months after the arresting incident and was given 3 years felony probation under supervision of a probation officer. You Wilbur Oliver Could you clarify what specific information or guidance you are seeking regarding your ex-partner's case and the probation? She unfortunately ended up returning back into my life and she went on to repeat these same behaviors and again she was arrested for a second battery charge, on top of the revocation of her probation. She was in custody for a pretty brief period of time before she was released to a deferment program. And and then once again ended up coming back into my life despite the no contact order. And ultimately this led to late last month when she attacked me with a knife and badly wounded my upper arm, which I needed ER treatment for due to its severity and have about a ~$* thousand dollar bill after my insurance maxed out, but there was no police interaction during this final assault from her. However, after a lot of reflecting and making some serious decisions, I had a "come to Jesus" this moment and I contacted her probation officer to inform them of what happened and my injuries. She was then arrested shortly after I spoke with her PO, and I now see she has her first court hearing tomorrow afternoon since the arrest. I know it's a hard question to answer because it can vary so much for so many different circumstances -but given the repeated pattern here and the ever increasing risk of injury to then straight up a life threatening wound - is there a way of estimating if these new violent charges that were all probation violations will mean her specific actions are likely to mean she will be held in custody for much longer than say, four weeks? I'm hoping to know if there is any way to estimate the likelihood that her behaviors and actions will result in her incarceration likely be held more towards the maximum length of stay than say the shorter periods of time like before (roughly *-* weeks maximum in custody in the past)? I don't think so - also just curious about what the standard protocol judges and prosecutors typically follow when it comes to repeat violent DV batter offenders that even after experiencing the consequences of violating probation will continue to knowingly and intentionally commit brutal acts of abuse that then escalates to the use of a weapon?
Case Rating: *.
****, given the repeated and escalating nature of your ex-partner's behavior, the following points should be considered:
- Probation Violations: Multiple violations, especially involving violence, can lead to a revocation of probation.
- Use of a Weapon: This significantly increases the severity of the charges.
- Judicial Discretion: Judges may impose harsher penalties for repeated offenses, including longer incarceration.
It's likely she will face more severe consequences this time. Stay safe and consider seeking a protective order.
Is there anything else specific you need help with?
