In hopkins county ky. I want to explain a situation and want to know if and what criminal charges could be fed
Hi ****! Please provide more details about the situation so I can help determine what criminal charges might be applicable in Hopkins County, KY.
My mother was taking her dog out for a walk. Now this dog is big ans she is very small. The dog had countless times before had gotten spooked thus taking off pulling my mother down and dragging her. The dog getting spooked easily and taking off was information everyone who was atound on a regular basis was well aware of. A person who lived on my mothers property hid in the dark and made a noise that spooked the dog. My mother also heard the noise so the person making it had to be pretty close by because her hearing wasnt the best
It sounds like there might be a case for negligence or possibly reckless endangerment against the person who intentionally spooked the dog. In Kentucky:
- Reckless conduct that endangers another person can be classified as wanton endangerment under KRS *.*.
- Intentional acts causing harm could be considered harassment or assault.
Was your mother injured due to this incident?
Let me finish.
Got it, ****. Could you please continue and let me know if your mother was injured due to this incident or if there were any other significant consequences? This will help in understanding the potential charges better.
My mother said that the dog got spooked but didnt take off so she tried to hurry it up the stairs to the back porch to get the dog inside before the noise happened again and the dog took off. Before my mother could get up the stairs they heard the noise again thus causing the dog to take off and pull my mother down the stairs landing on her face causeing a brain bleed which ultimately led to her death. Now we know who the person was who made the noise and the fact that he made the noise a second time leads me to belive that he was intentionally trying to get the dog to take off.
I'm really sorry to hear about your mother's passing, ****. Given the circumstances:
- Wanton Endangerment (KRS *.*): Recklessly creating a substantial risk of serious physical injury or death.
- Involuntary Manslaughter: Causing death due to reckless behavior.
Have you reported the incident to the local authorities?
