Help
Hello ****, can you please specify what part of the non-compete you need help with? This will enable me to provide a more focused response.
This the one that seems to be tripping them up- the first lawyer read it as PedsOnes clients who use PCC. The second one said it was not clear and the third one said he read as we cannot do any RCM work for any type of doctor not just pediatrics
*. The Restricted Business. The Company and I understand and agree that the
business of the Company includes, without limitation: revenue cycle management, billing and
consulting services for pediatric practices, and any other products and/or services offered by the
Company for clients who are also clients of Physicians Computer Company (PCC) either (a)
during my employment with the Company; or (b) during the Restricted Period (collectively, the
“Restricted Business”).
Hello ****. The clause you shared seems to restrict you from providing revenue cycle management, billing, and consulting services for clients who are also clients of PCC:
- During your employment
- During the Restricted Period
The clause appears to apply to pediatric practices, but may extend to other types of practices if they are clients of PCC. It's best to consult a lawyer for clarity.
Do they have to be a current “the company” client too?
Hello ****. Based on the clause you shared, it seems the restriction applies to clients who are also clients of PCC, regardless of whether they are current or past clients of "the company". However, legal language can be complex and it's always best to consult a lawyer for a personalized understanding.
