Vaccination Requirements For Caregivers

Summary

HIPAA does not prevent employers from asking about vaccination status. EEOC guidelines allow employers to require vaccination if job-related and consistent with business necessity. Reasonable accommodations must be provided for employees unable to receive the vaccine due to disability or religious beliefs. If no reasonable accommodation is possible without undue hardship, you may lawfully exclude the employee from the workplace. Consult a local attorney for specific advice.

I have a small non-medical in home care business and my clients are demanding vaccinated caregivers however I want to know if it is a HIPAA or EEOE violation to ask and filter jobs by these criteria
Hello ****,
- HIPAA only applies to certain entities like healthcare providers and doesn't prevent employers from asking about vaccination.
- EEOC guidelines allow employers to require vaccination if it's job-related and consistent with business necessity.
- However, reasonable accommodations must be provided for employees unable to receive the vaccine due to disability or religious beliefs.
Please consult a local attorney for specific advice.
With regards to accommodations if I have an employee who for religious beliefs does not get vaccinated then my clients want vaccinated caregivers and no other jobs are available what do I do?
In such cases, the EEOC suggests:
- Exploring accommodation options like alternative assignments or use of personal protective equipment.
- If no reasonable accommodation is possible without undue hardship, you may lawfully exclude the employee from the workplace.
Please consult a local attorney for advice tailored to your situation.
