Unlawful Termination Reinstatement Guide
Summary
If you were unlawfully terminated from an apprenticeship due to mental health issues, you may have a case for wrongful termination under the ADA and WLAD. Employers must provide reasonable accommodations unless it causes undue hardship. You can request medical leave under FMLA or WFLA if unable to work. Accommodations may include flexible hours, remote work, or modified duties. Consider drafting a letter to clarify reinstatement offers and accommodations. Consult a local attorney for personalized advice.Full Conversation

It sounds like you have concerns about being able to return to work before starting your treatment. Here are a few things to consider:
- You may request a leave of absence or medical leave until you begin treatment and your doctor clears you to work.
- Make sure to communicate with your employer about your treatment timeline and any documentation your doctor can provide.

In Washington, you can request medical leave under the Family and Medical Leave Act (FMLA) or the Washington Family Leave Act (WFLA). Here’s what you can do:
- Request a medical leave of absence from your employer.
- Provide documentation from your doctor about your inability to work and treatment plan.

It sounds like you might have a strong case for wrongful termination and failure to accommodate your mental health condition. Here are a few points you should consider:
- You may be protected under the Americans with Disabilities Act (ADA) and the Washington Law Against Discrimination (WLAD).
- Your employer is required to provide reasonable accommodations unless it causes undue hardship.
- Termination due to inability to work without offering leave could be a violation.

I hope this letter finds you well. I am writing to seek further clarification regarding the offer to reinstate me to my previous position with full accommodation for my mental health diagnosis.
While I appreciate the offer to return to work, I have a few concerns and questions that need to be addressed to ensure that the reinstatement process is smooth and conducive to my health and well-being.
*. Specific Accommodations: Could you please specify the exact accommodations that will be provided to support my mental health condition? Examples of accommodations I may need include flexible work hours, a quiet workspace, additional breaks, remote work options, or modified job duties.
*. Medical Leave: As my doctor has not yet cleared me to return to work due to my ongoing treatment, I would like to know if I can request a medical leave of absence until I am fit to resume my duties. Could you provide information on how to apply for this leave and any documentation required?
*. Reinstatement Timeline: Could you provide a detailed timeline for the reinstatement process? This will help me plan my return to work and coordinate with my healthcare provider.
*. Support During Transition: Given the circumstances of my termination, what support and resources will be available to me during the transition back to work to ensure a positive and healthy work environment?

yes, a couple years ago, as a. union apprentice, I went to my union rep and complained about sex discrimination and a hostile work environment on a job. Rather than give me a fair investigation, they decided to believe the employer even though the same person had prior trouble and required that I be moved. Well the move turned to be even more hostile and I was subject to abuse. As a result I developed a mental health disorder and have been trying to get help from the union with no help. They actually put me on probation after I told them I can not control my symptoms. Well recently, the union hall got taken over by a trusteeship due to improper practices and failed duties, and I am one of those who were injured by them.

I recently had a meeting with the director of the apprenticeship where they told me that they want me to be re-instated with full accommodation and such, I told them that I needed to talk to my doctor and I was worried that the last three years of damages are going to be swept under the rug. I was told just to let him know when was ready and now I can't get a response.
