Drug Screening Dispute Rights

Summary

Employers must provide pre-adverse and adverse action notices before rescinding a job offer based on background checks, including drug tests, under the FCRA. Drug test results typically require review by a Medical Review Officer (MRO) before employment decisions. If you believe there was a willful or negligent handling of your drug screening, consider consulting an employment law attorney. You may also file a complaint if FCRA procedures were not followed.

I believe this may be a willful or negelent situation with the mro review. I emailed orangetree background check and explained the issue and was told not all drug screen results go to mro for review. I stated back thst this specific test stated ot gets reveiwed by the mro. The lady said she is waiting for confirmation from the health team? I have not received any response sense. Thst was at least * to * weeks ago.
