I have had my medical marijuana card in Maryland for about 2 years now, but now I am moving to NC and have landed a job there. They require a drug screening as well. Since I had a medical card for Maryland and I was only using medical marijuana in that state, I will still have some in my system, so will I be penalized for that? Because I only partook under legal circumstances
Hello ****, while Maryland recognizes medical marijuana, North Carolina does not have similar laws. Your potential employer in NC has the right to enforce their drug screening policies, regardless of your previous medical marijuana usage in Maryland. It's advised to discuss this with your new employer before the drug test.
How is that fair though? It is legal in Maryland and I only used in Maryland, but obviously it's going to stay in my system for some time once I move to NC. I shouldn't be able to be legally punished for that.
Hello ****, I understand your concerns. However, legality differs across states. North Carolina currently has no protections for medical marijuana patients. The employer's rights to enforce their own drug policies supersede the legality of usage in a different state. It's recommended to consult with a legal professional in NC to better understand your rights.
