Workplace Safety Legal Concerns
Summary
Your situation involves potential breaches of the Health and Safety at Work etc. Act 1974, Confined Space Regulations 1997, and Employment Rights Act 1996. Employers must ensure safe working conditions, conduct risk assessments, and provide necessary training. Employees are protected from unfair dismissal for refusing unsafe work. Similar cases have been ruled in favor of employees at employment tribunals. You can find more information on tribunal outcomes through resources like the Employment Appeal Tribunal (EAT) website, BAILII, and Acas. Consider consulting these resources for detailed case studies and legal precedents.Full Conversation
can you help with employment law uk
Of course! I'd be happy to help with employment law in the UK. Could you please provide more details about your specific issue? For instance, are you dealing with unfair dismissal, discrimination, contract issues, or something else?
my team leader asked me to clean the ballistic separator, an open vessel with only one door to get in and out, classifying it as a confined space. I asked my team leader what the emergency plan was, specifically if it was to call *. He went away to check and later onfirmed that calling * was the plan. I communicated to my team leader that I felt the emergency plan was inadequate and not sufficient enough. He then asked if I was doing the ballistic separator, to which I replied, "No, as I feel the emergency plan is wrong and not sufficient enough." He then said, "If you refuse to go in and do it, I will have to send you home." I responded, "If that's what you got to do." He then asked, "Are you refusing to do a reasonable request?" I said, "If that is what you are calling it."We then went to the office, and he asked me one more time in front of Adam Spears. Again, I said no.
It sounds like you're dealing with a potential workplace safety and employment issue. Here are a few key points under UK law:
- Health and Safety at Work etc. Act *: Employers must ensure, so far as is reasonably practicable, the health, safety, and welfare at work of all their employees.
- Confined Space Regulations *: Specific regulations for work in confined spaces, requiring proper risk assessments, emergency procedures, and training.
- Employment Rights Act *: Protects employees from unfair dismissal, including refusal to perform unsafe work.
It might be beneficial to speak with your HR department or a legal professional. Would you like contact details for legal advice services?

my employers are in breach of * regulations which I believe I can prove Health and Safety at Work etc. Act *, Confined Space Regulations *, Employment Rights Act *. I was employed for less than 2 years but my claim would be automatically unfair as I was dismissed for refusing to do a task that was to go inside a confined space. I refused under health and safety concerns as The emergency plan for this if anything were to happen while inside, was to call *. this is a clear breach of regulations, after further looking into this and finding that the risk assessment was completed *-3 months after working in and on the machine, as well the gas reading for the machine was not being done. we then had training on confined spaces *-8 months after starting work on the machine, which further confirmed my suspicions, and I eventually refused to do that task,
