Hello Angela, thank you for providing your location. Could you please explain the legal issue you're experiencing in West Virginia so I can assist you better?
My brother passed away and in his will he left me his house and his ex wife lifetime rights to this house. She doesn’t want the house but I am being told that I have to pay the ex wife so she can waive her rights to the house. Do I have to pay for her to do so since she is waiving her rights to any claims at all of the house ? The executor says I do but I don’t think that is right.
Hello Angela,
This is a complex situation and laws may vary, but generally:
- The ex-wife may have a "life estate" which gives her the right to use the property during her lifetime.
- To give up this right, she may request compensation.
- This is usually negotiated and is not a legal requirement.
Please seek legal advice to understand your specific case.
