Question about what to do. So a sibling of mine is the trustee of our late fathers estate. I have been working to reach a settlement with them as they are withholding the distribution of the trust pending them receiving the house. They refuse to draft a formal agreement, and have not accounted yet for all assets of the estate despite my requests. Today I found out that the trustee has been receiving money from farming and tree harvesting from land that belongs to us * siblings and has been depositing it into their personal account and not into the estate. What do I do?
It sounds like your sibling may be breaching their fiduciary duties as trustee. In Indiana, you can take the following steps:
- Request a formal accounting of the estate through the court.
- File a petition to remove the trustee if they are mismanaging the assets.
- Consider consulting with an estate attorney.
