California Trust Document Concerns
Summary
Disclaimers in California trust documents clarify the lawyers liability and emphasize the trust creators responsibility. Concerns about the trustors mental state or potential undue influence can invalidate a trust. Selling property to oneself before becoming a trustee may breach fiduciary duty. To verify allegations, gather medical records, trust documents, communications, financial records, and witness statements. Request documents formally from relevant parties, such as lawyers and trustees. In California, trustees should respond within a reasonable time, typically 30 days. The anti-lapse statute prevents gifts to deceased heirs from lapsing. Use a Declaration form (MC-030) to make an official statement. Consider legal advice for personalized guidance.Full Conversation

In California, the anti-lapse statute prevents gifts to deceased heirs from lapsing and passing to their descendants. To invoke this law without court proceedings, you typically need to include a provision in the trust or will. However, if the trust doesn't specify, you might still need court intervention.
