I currently own my mother‘s house. It’s been in my name for the last 20 years. She currently has a Will that is supposed to be split four ways when we sell the house between my siblings and me. I’ve put thousands of dollars in on renovation to this house, and was wondering if this will go into probate or could I do a promissory note that the funds will be taken off the top of the sale of the house given to us directly before it split between siblings
Hello Teresa,
*. If the house is in your name, it won't be part of your mother's probate estate.
*. You can include a promissory note in your mother's will to reimburse renovation costs before distribution. However, all parties involved must agree.
*. Please consult a local attorney for more specific advice.
