Third Party Trust Validity
Summary
A third-party Special Needs Trust (SNT) in Colorado can be valid even if not recorded, as long as it meets legal requirements and is properly executed. Notarization alone can validate a document, but recording it with the county provides public notice and protection against claims of invalidity. If the original trust document is lost, consider recreating it with the original parties and ensuring its notarized again. For a simpler approach, creating a family trust might be more manageable, especially if mental health is a concern. To relieve a trustee, follow the trusts provisions for resignation and ensure a successor is ready. If the original trust no longer exists, the successor may not have duties unless a new trust is created. Consider consulting a legal professional for personalized advice.Full Conversation
Well my origi al and only copy was accidentally shredded as it had been placed between * other documents that were unrelated documents. So I am up a creek with no paddle?
Oh no! That sounds stressful. Here are a few steps you might consider:
- Recreate the Trust: If possible, work with the original parties involved to recreate the trust document.
- Notarize Again: Once recreated, ensure it's notarized again for validity.
- Store Safely: Keep multiple copies in secure places, like with an attorney or safe deposit box.
Would you like help connecting with local legal professionals who can assist you further?

Ugh! It took months, not weeks yo draft the original since it was very specific. I thought the same thing as you. My concern is that I will neglect to add specific clauses which honestly cant recall thier purpose. Ugh again. As this point the task of recreating the darn thing id to ardous to my brain. My SNY beneficiary is understanding and is actually ok if we cannot proceed. She suggest jusy creating a family trust when I have the energy to. What do you think?
Creating a family trust might be a simpler and more flexible option if you're feeling overwhelmed. It allows you to cover broader assets and beneficiaries. However, if the original trust had specific clauses for the SNY beneficiary, you may need to recreate it eventually. I might but hoe in the world would I actually know the specific clauses you say I can add. Im thinking it will have just enough forgotten info and newly added info that it eill not be s true replies of the orignal SNT. I just want to lay down, close my eyes and wake up to this ne er having happened. My mental hezlth is on the fringes now.

Thanks for hearing me out. It helps so much. Also before I go, what do I tell the trustee to do so he's free of his role?

I feel so dense. What will the successor trustee take over. Obviously not a no longer existance 3rd party sny

The successor trustee typically takes over managing the assets and fulfilling the terms of the trust as outlined in the trust document. If the original trust no longer exists, the successor trustee may not have anything to manage, unless a new trust is created. Consider creating a new trust or restructuring your estate plan to ensure proper management and distribution of assets. If you need more guidance, feel free to ask!
