me, and my soon to be ex-wife have been in a divorce proceeding for two years now I am representing myself after I fired my lawyer for not doing anything in the door to help me. I have a prenuptial agreement that my wife requested upon getting married we got married in Mexico And the prenup was made and signed there signed by her adult daughter and one of her adult daughter’s friends, which is also an adult plus there was over * witnesses because we signed it at the wedding in front of everyone. I am noticing right now that on the marriage certificate and on the prenup she put her Name as Guadalupe Prado Mendoza, which was her birth name, but many many years ago when she moved to United States and got married to her first husband, the father of her children she legally changed her name to Guadalupe Galindo, taking his name. She never changed her name after divorcing him, so her legal name has stayed Guadalupe Galindo, but now I’m noticing that on our marriage certificate and our prenuptial agreement, she signed her name as Guadalupe Prado Mendoza, which is her birth name that she does not legally go by anymore, but in the divorce in court, our divorce case she has been putting her name as Guadalupe Galindo her legal name There has been many false allegations by her. She’s hiding financial assets. She’s trying to falsely accuse me of things she’s harassed me. She’s broken a restraining order violated it. I have a contempt of court against her right now that we’re still waiting for, but what we are going to go into trial for in a few days is for the prenuptial agreement that I submitted recently. How should I address this name situation of her that she’s using two different names plus what is the situation here that she signed on our marriage certificate and the prenuptial agreement that her name was something that legally is isn’t anymore? Are we even legally married?
The name discrepancy in the prenuptial agreement and marriage certificate could be significant. You should bring this to the court's attention, emphasizing that the use of her birth name might indicate an attempt to mislead or complicate legal proceedings.
- Highlight the name inconsistency: Explain how she used her birth name (Guadalupe Prado Mendoza) on legal documents despite legally being Guadalupe Galindo.
- Argue the impact: Show how this inconsistency could affect the validity of the prenuptial agreement and potentially the marriage.
- Address other issues: Mention her false allegations, hidden assets, harassment, and restraining order violations to strengthen your case.

How could this inconsistency of hers affect the validity of the prenuptial agreement because that is all I am hoping for at this moment is for that prenuptial agreement to work in my favor because that was the agreement from the very beginning what’s mine is mine what’s hers debt property everything she’s taking out liens on all my properties and I have not been able to resume work in two years and those liens that she took out on my properties I feel like are you legally Done because of the prenuptial agreement that she requested so now that I have filed it I was hoping that when the trial date came a few days from now that the judge would see the prenuptial agreement and agreed that it is enforceable but now with all this name situation, how is that gonna affect The prenuptial agreement on for me?
The name inconsistency could potentially affect the validity of the prenuptial agreement. Courts look at the intent and good faith of parties involved. Highlight how her use of a different name might show an attempt to mislead.

- Enforceability: Courts may question the authenticity and enforceability of the agreement.
- Legal Consistency: Emphasize her history of using different names to strengthen your argument.

that’s the problem. I don’t want these inconsistencies to undermine the validity of the prenuptial agreement because that was all I was holding on hope for I need this prenuptial agreement to be valid so that I can move on with my life and get done with this. Is there no way that only she would get repercussion for lying about her name, I mean that she’s still signed it, but she was trying to deceive because of putting a different name so why is that gonna bite me in the butt and make it to where this isn’t valid that’s just gonna screw me up. I need a way to be able to show the court that she’s been lying that she has been inconsistent with her legal names, trying to deceit the courts in legal proceedings, but I also need the prenup to hold ground, and then go through for my sake.
You should argue that the prenuptial agreement remains valid despite her name discrepancy. Focus on:
- Intent: Demonstrate her intent to deceive and not your fault.
- Witnesses: The agreement was witnessed by many, supporting its validity.
- Consistency: Highlight her consistent use of her birth name for this agreement.
