In Illinois I previously had an order of protection on an ex whom violated it twice and went to prison. Now is out on ankle monitor for 4 years parole stipulation is zero contact with me including third party. Beginning March this year he has done exactly that 3rd party communication and in July used his girlfriends mom's facebook messenger to message me that he is glad my friend is dead and called foul names afterwards. I am seeking to get another order of protection on him and was denied the emergency order of protection since it was not physical contact. Plenary hearing is coming up. An attorney whom I had a consult with today told me the judge more than most likely wont grant me an op based on the third party communication since he did not use his phone or fb account directly cant prove it was him. Is that true
Hey ****, sorry to hear about your situation. In Illinois, getting an order of protection based on third-party communication can be challenging if direct evidence linking it to the person is lacking. However, presenting all relevant evidence, like the content and timing of messages, could still be helpful. Have you considered gathering additional evidence that might help prove the connection?
Such as what additional evidence?
In situations like this, gathering evidence to strengthen your case is crucial. Here are some suggestions:
- Document all instances of communication, including screenshots and dates.
- Gather witness testimonies from people aware of the communication.
- Present any patterns or behaviors that show a connection between your ex and the third party.
- Check if there's any common language or unique identifiers in the messages that could link them to your ex.
Would you like more information on how to present these in court?

Hey ****, it's tough when resources are limited. You might want to consider reaching out to other legal aid organizations or community legal services. They sometimes have different criteria or can suggest alternative support. Have you explored any other legal aid options in Illinois apart from Land of Lincoln?
