Tax Dependency Legal Guidelines

Summary

If your spouse deserted you over two years ago and provides no financial support, he likely cannot legally claim you as a dependent on his tax return. The irs requires dependents to meet specific criteria, including financial support. You can file your own tax return to document your status, report potential fraud to the irs, and consult a tax professional or attorney for guidance. In north carolina, marital abandonment can impact alimony decisions, and you can file for divorce after one year of separation, even if you cannot locate your spouse. Serving notice through publication is an option. Consider contacting legal aid organizations in north carolina for free assistance with tax, housing, and divorce-related concerns.

It is a matter to do with tax returns that my husband is still claiming me , i was a depentant spouse, homemaker. The thing is we have been apart over 2 years and he deserted me by leaving our marital home and never returning and i have very little contact with him and he does not support or help me financially at all. Is he able to claim me without my permission?
If you and your husband have been separated for over two years and he provides no financial support, it is unlikely he can legally claim you as a dependent on his tax return. The IRS requires that a claimed dependent meet certain conditions, such as receiving financial support from the person claiming them.
Steps you can consider:
- File your own tax return: This ensures your status is properly documented.
- Report potential fraud: If he is falsely claiming you, you can report this to the IRS (Form *-A).
- Consult a tax professional or attorney: They can guide you on correcting any issues.
