Proving Common Law Marriage

Summary

In Oklahoma, proving common law marriage requires agreement, cohabitation, and presenting as a married couple. Child support back pay is generally limited to two years prior to filing. SSDI back pay is considered income for child support calculations. Judges must sign off on back child support orders to make them enforceable. Redacting personal information in legal documents is generally acceptable. Consider seeking legal aid or law school clinics for assistance.

I have trial against my ex husband and im trying to prove common law marriage in state of oklahoma because we were together for * hears but i had not finalized divorce from first husband until one year before my husband im separated from left to go home to his moms house. He is sick , got $*,* back pay of ssdi and has lied about receiving this money for over a year. I did get full custody in same case of our 16 year old son this past summer. He has not paid me a dime in three years this coming November and i have had our son living with me by myself providing for us while he gets to live montgky off his little $* a month ssdi check i have to pay $* in rent and im only making $*! Right now! He has no bills, moms hpuse is completley paid off and i am only getting $* a month child support from some jew redicykous calculations they have in oklahoma! That is not even enough for a tank a gas a week!

Anyway..i have to have my discovery handed over to his rich , stuck up Edmond Attorney, by the 7th of October, we are both from edmond , ok grew up there but im screwed representing myself! The judge is already a smart ass to me and i just need help making sure that when i speak at trial and then in a month with the mediator that i have all factual information, which I do but how and why does a judge have to sign off on back child support order and is it law that the state of oklahoma child support division can only go back two years for back pay on child support?
Handling this situation on your own can be challenging, but here are some important points to consider:
- In Oklahoma, a judge must sign off on a back child support order to ensure it is legally binding and enforceable.
- Oklahoma law generally allows for child support back pay to be claimed up to two years prior to the filing date.

Well it will ne three years in November do thats kind of bullshit , honestly. Ok here is one more thing i need clarification * percent on is that ive looked this information up with the social security admin. as well as somewhere in the statutes for state of oklahoma ..legally since my ex husband got the $*,* back pay within the last two years of our separation that however it was divided up, being one lump sum or divided into a few months, the $*,* he received for his back pay is counted as income for the mo th he receives it so the calculations they use to figure my back child support will be based on that amount for the months he received it against my little $* a month.correct
