SUBMISSION TO SCHUYLKILL COUNTY COURT
Date: February *, *
Re: Procedural Violations, Civil Rights Violations, and Criminal Misconduct by Child and Youth Services (CYS) in Dependency Proceedings
---
I. Introduction
This submission presents overwhelming evidence of procedural and constitutional violations by Child and Youth Services (CYS) in the current dependency proceedings. The actions of CYS have resulted in egregious due process violations, misrepresentation of evidence, and failure to comply with state and federal law. Accordingly, the parent requests that this Court:
- Dismiss the dependency proceedings in their entirety due to multiple due process violations.
- Order an immediate return of the child to the parent's custody with zero restrictions due to false accusations and interference with due process by misleading statements.
II. Key Legal Violations
*. Failure to Provide Timely Notice and Service (Violation of State Law & Due Process)
- CYS violated * Pa.C.S. § *(a) (Shelter Care Hearing Statute) by failing to provide timely notice of the *-hour hearing. Parents were denied the opportunity to attend and defend their rights.
- Requested Remedy: Court should suppress any evidence presented at hearings where the parent was improperly excluded.
*. Due Process Violations Under the Fourteenth Amendment
- CYS's failure to provide timely notice deprived the parent of their fundamental right to raise their child under Santosky v. Kramer, * U.S. * (*).
- Requested Remedy: Dismissal of proceedings due to lack of fair notice.
*. Fabrication of Evidence & Misleading Conduct by CYS (Irrefutable Criminal Violations)
- Evidence will show CYS caseworkers provided false and misleading statements, such as timelines of having authorization for emergency custody of Ariella Nicole Lorah, which led to a wrongful shelter care determination. This is a violation of:
- * Pa.C.S. § * (Unsworn Falsification to Authorities)
- * U.S.C. § * (Civil Rights Violations - Fabrication of Evidence)
- Requested Remedy: Sanctions against individual CYS employees and a court order requiring an independent investigation into CYS's misconduct.

- Hold individual CYS employees personally accountable for misconduct.
- Refer CYS’s violations to the Pennsylvania Office of State Inspector General, HHS, and Pennsylvania Board of Social Workers for potential disciplinary action and licensing review.

Dear Judge [Judge’s Last Name],
I am writing to provide my account of the events concerning the procedural and constitutional violations by Child and Youth Services (CYS) in the dependency proceedings involving my child, Ariella Nicole Lorah. The statements provided by CYS and involved parties contain several inaccuracies and misrepresentations, and I wish to clarify the sequence of events as follows:
*. Initial Interaction with Hospital Staff
- On [date], at WellSpan Good Samaritan Hospital, my daughter Ariella underwent unauthorized medical procedures despite my explicit instructions. The nurse performed a procedure I specifically requested not to be done and removed the umbilical cord clip, causing distress to my daughter.
*. Misleading Statements by CYS
- CYS provided false statements regarding the timeline of authorizations for emergency custody of my daughter. The affidavit provided during the supervised visit indicated a time of *:* PM, which was after my daughter was taken at *:* PM.
*. Violation of Parental Rights
- The nurse violated my parental rights by performing unauthorized procedures and misleadingly reporting the events. CYS compounded this by failing to provide timely notice of the *-hour hearing, denying me the opportunity to defend my rights.
*. Evidence of Misconduct
- I have documented evidence, including false statements by CYS caseworkers and unauthorized medical procedures performed on my daughter. This evidence highlights due process violations and misleading conduct by CYS.
*. Requests to the Court
- Dismiss the dependency proceedings due to multiple due process violations.
- Order the immediate return of my child to my custody without restrictions.
- Compel CYS to produce all internal communications and case-related records.
- Hold individual CYS employees accountable for misconduct.
- Refer CYS’s actions to appropriate state and federal authorities for review.
I urge the Court to consider the evidence and the harm caused by the actions of CYS and hospital staff. I am committed to ensuring the best interests of my child and seek redress for the violations endured.
Thank you for your attention to this matter.
Sincerely,
Justin Lorah

She also withdrew more blood from my daughter and that was the major issue I had. They had done it for five times already for testing for jaundice. They have a non painful test that they can use involving a device going across the skin and that's what I requested. She lied to me and told me she would use the skin test and took my daughter out of the room and proceeded to withdraw the blood behind my back
