My friend is going through a custody battle. I attended court with her (as a support person). She had no representation at the time. The judge decided on the father, getting the child, a sole custody, and that the mother, my friend can only see her daughter was supervised visits. She informed the judge that she was temporarily staying with me, the judge asked for my name She gave it to him, and then he asked for the spelling of my name which I willingly gave him. I just found out that the court order specifically states that visitation can only occur at my home. I never agreed to this. I was under the impression that visitation with the daughter would occur in settings with family and friends, and in addition could take place at my home while she was staying with us. She is no longer staying with us. I want my name removed from this court document. How do I go about this?
Hey ****, that's quite a situation. To remove your name from the court document, you might consider filing a motion to modify the court order. This will allow you to explain your position and request the removal of your home as the designated visitation site. You might want to consult with a local attorney for guidance on the specific process in Indiana. Is this something you would like to pursue with a local lawyer's help?
No. I’m not paying for lawyer as I am
You can try handling this on your own by following these steps:
- File a "Motion to Modify" with the court that issued the order.
- Clearly explain your situation and why you want your name removed.
- Provide any evidence or documentation supporting your request.
- Attend any court hearings related to your motion.
