If my wife handed over our kids cell phone, but I am the only one on the plan as my wife has her own separate account. Can I legally get my phone back? When I went to the police I explained as the sole owner they need my permission to go through the phone. Additionally the officer mentioned something a kid said to my daughter and said as a father he’d be talking to their parents. This shows me he’s already going through it even though the forensic guy wasn’t there.
It sounds like a complex situation. Here are some general legal points to consider:
- As the account holder, you typically have certain rights over the devices on your plan.
- Law enforcement generally needs a warrant or your consent to access the contents of a phone.
- Consult with a local attorney for specific advice.
