Hi Callista! How can I help you with your legal issue today?
I’m fighting for full custody of my daughter, can I explain the situation so you’re aware of everything
Of course, Callista! Please go ahead and share the details about your custody situation. Understanding more about it will help me provide you with relevant legal information.
I’ll give a little run down on the situation. My ex husband and I were together for 9 years, it was very abusive. I was held against my will by him in his truck while he was going over 100mph while he had a gun to my head for * hours then more abuse when we got home. I started to secretly think of a way out. He then went to jail for unrelated gun charges against a civilian who he had an issue with. He went to jail for 5 days and shortly after I told him I wanted a separation. Sept * we got along fine, we communicated about the schedules and I had our daughter full time and I let him do his own thing having her when he felt comfortable bc he was overwhelmed by the responsibilities of being a dad since he never had her by himself not once.
Hi Callista, it sounds like you're going through a challenging situation. For custody cases, Michigan courts prioritize the child's best interests. Here are some key factors they consider:
- Each parent's ability to provide for the child's needs.
- History of domestic violence.
- Emotional ties between the child and parents.
Have you filed for custody yet, or are you considering it?
We did our best to make it work, summer of * he got a new gf and instantly cut communication with me, filed for full custody after not seeing her for months, he will not coparent and tells me to “text Payton” he is absent from the household from March-dec for work and he relies on Payton to do his parental duties. He is aggressive if he does speak to me. Payton is very disrespectful and bashes me on social media and says that she is doing my job and killing it and I’m just an egg donor. They don’t have a schedule or routine for Layla. They have her out late on school nights. They keep her home from school if Payton works late. I’ll ask to have her since her father isn’t present and I’m told no but she goes to a sitter.

Also, Payton has lost Layla in a store and had to get help to find her. They haven’t treated her for any medical issues at all. I have her family doc, eye doc, dentist and therapist all in the city where I live all by me. They speak down on me to Layla and don’t allow her to talk to me when she’s there. They use her profession as a social worker to make her look better and more acknowledged in child care. They continue to make false claims that I am an addict and I drink everyday although they are projecting since I am completely sober as of oct * while I have a written statement by Kyle’s step sister who has done drugs with them both and Payton while intoxicated broadcasted Kyle’s drug use.
