I'm having an issue with my neighbor in an apartment complex and with the property management company. I live in Texas. The downstairs neighbor constantly complains about noise from above, but my family doesn't do anything to cause excessive noise- in fact, since this has been brought to our attention, we are actively trying to reduce the amount of noise we are making, doing things like taking softer steps and stopping our 6 year old son from running, jumping, and dancing inside the apartment. The complaints keep coming though. Now there is a notice that the property management company wants to tour our unit to assess the situation. Am i in danger of being evicted? What can I do to remedy this situation?
I understand this situation is stressful, ****. In Texas, landlords can initiate eviction for disturbances, but they must follow a process:
- Written notice of violation and time to cure it.
- If not resolved, eviction notice can be served.
To protect yourself:
- Document your efforts to reduce noise.
- Cooperate with the management's tour.
- If eviction notice is served, consult a lawyer.
Remember, this is general advice and specific laws may vary.
is there any way i can prvoe that we aren't doing anything to violate the lease?
In order to prove you're not violating your lease:
- Keep a noise log detailing the dates, times, and nature of your activities.
- Record any conversations or interactions with your neighbor or management.
- Gather witnesses who can attest to your noise levels.
- Consider having a sound test done by an expert.
Remember, each situation is unique and these are general suggestions.
